The band plans to tour theaters across the U.S., beginning in September 2009. The band's name is an allusion to Evanescence's 2003 album, Fallen.
Originally called "The Fallen", the band was re-named after receiving a cease and desist notice from English cover band The Fallen, which has existed since 2005.
In a Los Angeles Times interview, guitarist Ben Moody said that We Are the Fallen differs from Evanescence in that "everyone is equal" and that it has "more energy than Evanescence could ever muster." Rather than an album, the band will release a few songs about every eight weeks for a year and a half.
On June 22, 2009, fans could register at the band's official website to receive a free download of their first single, "Bury Me Alive." Only the first 100,000 registrants qualified for the download. According to the band through a MySpace video, the response to the free download was "overwhelming". The song was then put on their MySpace while they worked on getting the downloads sent out.
